Celebrations of the Magna Carta last year claimed that rights have a longstanding domestic provenancein England, but not about its and ambiguous use in protecting rights. We often tell histories of continuity—this High Court decision on Brexit simply enforces the parliamentary sovereignty that has long been part of British governing—but these histories have a much more recent politics. Instead of telling stories focused on judges, we would all do well to notice the longer historiesand more complicated reasons for decisions.
