Peters v. Columbus Steel Castings Co., 2007 WL 2809958 (Ohio, September 20, 2007)
William Peters (husband) signed an agreement to mediate and/or arbitrate any and all claims against his employer, Columbus Steel Castings Co. (Columbus), as part of his employment agreement. Husband fell from a catwalk while at work and died. Alice Peters (wife) brought suit as next of kin against Columbus for wrongful death. Columbus moved to compel arbitration and was denied. Columbus appealed. Appellate court affirmed lower court. Ohio Supreme Court affirmed, based on the principle that contracting parties cannot bind non-signatories to arbitration. (JS)
